However, criminal behavior is rarely simple—it often stems from a complex interplay of psychological, social, and biological factors. Understanding how someone could commit an offense requires a multidimensional exploration of their mental and emotional state. Many offenders suffer from underlying mental health conditions that may have contributed to their actions, including substance abuse or past experiences with violence.
Mental illness is a clinical condition that affects a person’s cognitive, emotional, and behavioral functioning to the extent that it significantly impairs their ability to manage everyday responsibilities. Within the legal system, individuals who are unable to comprehend court proceedings or assist in their defense due to a mental disorder are considered incompetent to stand trial (Bartol & Bartol, 2020). Competency evaluations are therefore critical to ensuring justice while upholding the integrity and dignity of the court. These assessments guide decisions on whether an individual is fit to proceed through legal processes and whether alternative treatment or care should be prioritized. The expertise of forensic psychologists ensures that legal outcomes are both just and ethically sound.
Forensic mental health services form an essential bridge between healthcare and criminal justice systems. The primary goal of forensic psychological evaluations is to assess, interpret, and explain an individual’s emotional, cognitive, and behavioral capacities concerning specific legal issues. These evaluations not only determine competency but also help predict the likelihood of future offending behavior.

(2024), forensic assessments aim to provide treatment and support for individuals with mental illnesses who have committed crimes or who are deemed at high risk of offending. Competency assessments consider both historical and current psychological functioning, helping to determine whether the person’s mental condition affects their understanding of legal proceedings or their ability to participate meaningfully in their defense.
Competency assessments are typically requested when questions arise regarding a defendant’s capacity to comprehend or participate in legal proceedings. For instance, courts may order an evaluation to determine whether an individual is competent to stand trial (Neal et al., 2022).
These assessments explore whether the defendant:
Understands the nature and purpose of court proceedings
Recognizes the charges brought against them
Can effectively communicate with their attorney

Not all individuals with mental illness are absolved of criminal responsibility. Legal defense teams must carefully evaluate whether pursuing an insanity plea serves the best interest of their client (Bartol & Bartol, 2020). Reliability and validity are fundamental principles that determine the quality and credibility of forensic psychological assessments.
Reliability refers to the consistency and dependability of a measure—that is, whether the same results would be achieved if the evaluation were repeated under similar conditions. It reflects accuracy, precision, and the absence of bias in data collection (Karnia, 2024).
Validity, on the other hand, concerns whether the assessment truly measures what it claims to measure. A valid competency assessment accurately reflects the defendant’s mental state and ability to participate in legal processes (Murrie et al., 2023).
To ensure high reliability and validity, evaluators should:
Focus strictly on case-relevant information
Avoid including irrelevant or biased data
Conduct assessments well in advance (ideally more than 15 days before a court date)
Maintain appropriate licensure, certifications, and continuing education

The American Psychological Association (APA) Ethical Code of Conduct provides a framework for psychologists’ professional behavior. It ensures that psychological services uphold human rights, scientific integrity, and public trust (APA, 2017).
The principles of beneficence and nonmaleficence require psychologists to act in the best interest of clients and avoid causing harm. This principle is crucial when determining a defendant’s competency to stand trial, as evaluators must remain impartial and protect the individual’s welfare.
The principle of integrity emphasizes honesty and transparency in professional activities. Psychologists must accurately represent findings and avoid allowing personal bias or external pressure to influence their assessments.
Additionally, respect for people’s rights and dignity mandates that evaluators treat all individuals—regardless of their competency status—with fairness and humanity. A finding of incompetence should never be viewed as diminishing an individual’s worth. Rather, it signifies the need for therapeutic intervention before legal proceedings can resume.
When conducting forensic evaluations, psychologists are encouraged to:

Disclose any limitations in expertise
Uphold confidentiality and informed consent
Follow APA and jurisdictional laws consistently
